Agreement to Terms

By accessing and using aiWriter.ai ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account or use the Service. By using the Service, you represent that you meet this requirement. We may suspend or terminate any account we reasonably believe is held by someone under 18.

Description of Service

aiWriter.ai provides AI-powered writing tools and services, including but not limited to:

• Story generation and creative writing assistance
• Text processing and content creation tools
• Writing enhancement and editing suggestions
• Research and study assistance features

Our services utilize artificial intelligence and machine learning technologies to help users create, edit, and improve written content.

User Accounts and Registration

While some features may be available without registration, creating an account may be required for certain advanced features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information during registration
• Promptly updating your account information when necessary

Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Create, request, or generate any sexual or sexually suggestive content involving minors (anyone under 18), whether real, fictional, or AI-generated, in any form — text, characters, or otherwise. This is strictly prohibited with zero tolerance.
• Use the Service for any illegal or unauthorized purpose, or to create content that is unlawful in any applicable jurisdiction
• Generate content that is harmful, abusive, harassing, or discriminatory
• Create content that infringes on intellectual property rights
• Attempt to reverse engineer, hack, or compromise our systems
• Use automated tools to access the Service without permission
• Generate spam, malware, or other malicious content
• Violate any applicable laws or regulations

We enforce the prohibition on sexual content involving minors with zero tolerance. We use automated systems to detect and block such requests; blocked requests are not generated and may be logged. Violations result in immediate termination of your account without notice or refund, and we will report content to the appropriate authorities where required by law. We may also suspend or terminate any account, with or without notice, for any violation of this Acceptable Use Policy, and we may remove violating content under the “Content Removal” section below whether or not we terminate the account.

Content and Intellectual Property

Your Content

You retain ownership of any content you submit to our Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to process, store, and display your content solely for the purpose of providing our services.

Generated Content

Content generated by our AI tools based on your input ("Generated Content") is provided to you under a non-exclusive license. You may use Generated Content for personal and commercial purposes, subject to these Terms.

Our Content

The Service, including all software, technology, and intellectual property, is owned by aiWriter.ai and is protected by copyright and other laws. You may not copy, modify, or distribute our proprietary technology.

Content Removal

We may review User Content and Generated Content stored in your account — using automated systems, human review, or both — to detect violations of these Terms, our Acceptable Use Policy, or applicable law.

If we reasonably believe that content violates these Terms, our Acceptable Use Policy, or applicable law, we may remove it at any time, with or without prior notice, and whether or not we also suspend or terminate your account. We may do so regardless of your subscription tier or payment status.

Removal is permanent. We do not restore, recover, or export content once it has been removed, and we will not provide you with a copy of it before or after removal. We do not offer a user-accessible backup or archive of removed content.

Because content may be removed under this section, and because the Service may otherwise become unavailable, you are responsible for keeping your own copies of any work that matters to you. The Service is not a backup or archival service.

To the maximum extent permitted by law, we are not liable to you for the removal of content under this section or for any loss arising from it, and no refund or credit is due for content removed under this section. We may retain a record of a removal — including that it occurred, when, and why — after the content itself has been deleted, including where we are required to do so by law.

AI-Generated Content Disclaimer

Important considerations regarding AI-generated content:

• AI-generated content may contain inaccuracies, biases, or errors
• You are responsible for reviewing and verifying any generated content before use
• We do not guarantee the accuracy, completeness, or quality of generated content
• Generated content should not be considered as professional advice
• You should ensure generated content complies with applicable laws and regulations

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Service Availability and Modifications

We strive to maintain high service availability, but we cannot guarantee uninterrupted access. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time
• Update these Terms as necessary
• Limit usage to ensure fair access for all users
• Implement new features or remove existing ones

We will provide reasonable notice of material changes when possible.

Payment and Billing

Some features of our Service may require payment. For paid services:

• All fees are charged in advance and are non-refundable unless otherwise stated
• Annual plans include a 14-day money-back guarantee: contact us within 14 days of an annual charge for a full refund
• You authorize us to charge your payment method for applicable fees
• Prices may change with reasonable advance notice
• Your account may be suspended for non-payment

Automatic Renewal and Cancellation

Paid plans are subscriptions that renew automatically. Please read this section carefully.

• Renewal. A monthly plan renews every month and an annual plan renews every year, on the anniversary of your purchase, at the plan price shown at checkout (currently Plus $8.49/month or $84.90/year, Gold $14.49/month or $144.90/year) until you cancel. Each renewal is charged to the payment method on file.
• How to cancel. Sign in, open Account, choose Manage billing, then Cancel subscription. Cancellation takes effect at the end of the billing period you have already paid for; you keep paid access until then and are not charged again. You can also cancel by deleting your account from the same page, which ends access immediately.
• Refunds. Monthly charges are not refunded in part or in full once a billing period has started. Annual plans include a 14-day money-back guarantee as described above.
• Price changes. If the price of your plan changes, we will tell you by email before the first renewal at the new price, and you may cancel before that renewal to avoid it.
• Failed payments. If a renewal payment fails we may retry it and notify you; paid features are paused until payment succeeds or the subscription is cancelled.

Limitation of Liability

To the maximum extent permitted by law:

• Our Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability to you shall not exceed the amount paid by you for the Service
• We are not responsible for content generated by AI tools or your use thereof

Indemnification

You agree to indemnify and hold harmless aiWriter.ai and its affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your User Content or use of Generated Content
• Your violation of any laws or third-party rights

Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access to the Service immediately, without prior notice, for any breach of these Terms. Upon termination:

• Your right to use the Service ceases immediately
• You remain liable for any outstanding obligations
• We may delete your account and associated data

Dispute Resolution

Talk to us first. Before starting any formal proceeding, contact us at legal@aiwriter.ai with a description of the dispute and what you would like us to do. We will try to resolve it informally within 30 days.

Binding arbitration. If we cannot resolve a dispute informally, any dispute arising from these Terms or your use of the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect (available at adr.org). The seat of arbitration is Monmouth County, New Jersey, USA; hearings may be held by video or telephone, or on documents alone, at your election where the rules allow it. Arbitration fees are allocated as the AAA Consumer Arbitration Rules provide. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court instead of arbitration, and either party may seek injunctive relief in court to stop unauthorized use of the Service or infringement of intellectual property.

No class actions. Disputes are resolved only on an individual basis. You and aiWriter.ai each waive the right to bring or take part in a class, collective or representative action.

Opt-out. You may opt out of this arbitration agreement by emailing legal@aiwriter.ai within 30 days of first accepting these Terms, stating your account email and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

Consumers outside the United States. If you live in the European Economic Area, the United Kingdom or another jurisdiction whose law gives you the right to bring claims in your local courts, nothing in this section takes that right away, and the mandatory consumer-protection rules of your country of residence continue to apply.

Governing Law

These Terms are governed by the laws of the State of New Jersey, United States of America, and applicable United States federal law, without regard to conflict-of-law principles. Subject to the Dispute Resolution section, any court proceeding that is not required to be arbitrated will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction. If you are a consumer in a country whose law grants you protections that cannot be waived by contract, those protections still apply.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated (EST)" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

Effective Date
